7:00AM, 29 September 2003, A New Week -- New Congressional legislation (the appropriations Bill) would authorize a 10% or $10 million adjustment in favor of federal employees in competitive sourcing where 10 or more government employees are involved. Government Possibly Misplacing Information Does Not Entitle Offeror to Relief

In Shubhada, Inc., B-292437, September 18, 2003, the protester argued that its proposal was unfairly eliminated as technically unacceptable for failing to include a technical proposal. Both parties argued from recollections of matters that occurred months earlier. The protestor alleged that it had submitted the information and that the government must have lost the package containing the technical proposal. The government had no recollection that it had received anything other than the one package not containing the technical proposal. The GAO decided against the offeror, stating that an occasional loss, even if through agency negligence, does not generally entitle the aggrieved competitor to relief. The GAO further stated that the only means to reconstruct the package would be to consider copies offered by the offeror, but allowing an offeror to establish the contents of its lost proposal after the closing date would be inconsistent with maintaining a fair competitive system.

FY 2004 Defense Appropriations Act has been passed by both the Senate and the House and is on the way to the President. No word yet on the Authorization Act. Here is a site for some highlights from the Appropriations Act.

1:45PM Mid-Day Musings -- DPAP website is up. New information on new UID policy that has been signed out. There is a lot of good information at this website.

7:00 AM The Morning Review -- GSA has used an IT contract to buy mental health services -- my wife does say that sometimes computers drive her crazy. Qwest has been added to the list for possible debarment, Worldcom and Sprint are already under consideration -- where is Ma Bell when you need her?

What happens when the agency loses part of the offeror's technical proposal and the offer is found technically unacceptable and therefore rejected? So sad, too bad! In Shubhada,Inc., the GAO denied the protest finding that, "This arguably harsh result is justified by the unique circumstances arising in protests concerning lost information. The only means generally available to establish the content of lost information is for the protester to reconstruct that information. However, allowing an offeror to establish the content of its lost proposal after the closing date has passed would be inconsistent with maintaining a fair competitive system."

According to WIFCON this morning, the Senate Committee on Governmental Affairs has requested hearings on contracts in Iraq. Have not been able to get into the Director of Procurement and Acquisition Policy website lately.
